Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of the Servd platform, websites, and services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a business, you confirm you are authorised to bind that business to these Terms.

2. Who we are

Servd ("we", "us", "our") provides a QR-based ordering and analytics service for bars and restaurants. You can contact us at info@servd-ai.com. How we handle personal data is described in our Privacy Policy.

3. Eligibility and accounts

  • You must be at least 18 and able to enter into a binding contract to use the Service.
  • You are responsible for the information you provide, for activity under your account, and for keeping your login credentials secure. Tell us promptly if you suspect unauthorised access.
  • You are responsible for the access you grant to staff and team members, and for their use of the Service.

4. The Service

Servd lets venues create menus, take QR-based table and collection orders, accept payments, and view analytics. Features vary by plan and may change over time. We may add, modify, or remove features, and we aim to give reasonable notice of material changes.

5. Plans, billing and payments

Subscriptions

  • We offer a free plan (a single location) and paid Premium plans. Current pricing is shown on our pricing page and in the dashboard.
  • Paid subscriptions are billed through Stripe. By subscribing you authorise us and Stripe to charge your chosen payment method on a recurring basis until you cancel.
  • You can cancel at any time from the billing area; cancellation takes effect at the end of the current billing period. Some plans (e.g. annual contracts billed monthly) carry a minimum term, which will be shown before you subscribe.
  • Except where required by law, fees already paid are non-refundable. We may change pricing on reasonable notice, effective from your next billing period.

Customer order payments

  • Card payments made by your customers are processed by Stripe. To accept card payments you must connect a Stripe account and complete its onboarding.
  • You are the merchant of record for orders placed at your venue. Funds from customer orders are settled to your connected Stripe account, subject to Stripe's terms and any platform fee disclosed to you.
  • You are responsible for fulfilling orders, for the accuracy of your menu and prices, for tax, and for handling customer refunds and disputes for those orders.

6. Your content

You retain ownership of the content you add to the Service — including menus, images, prices, and business details ("Your Content"). You grant us a licence to host, store, display, and process Your Content solely to provide and improve the Service. You are responsible for ensuring Your Content is accurate, lawful, and does not infringe the rights of others.

7. Acceptable use

You agree not to:

  • use the Service unlawfully, or to sell unlawful or age-restricted goods without proper controls;
  • upload malware, attempt to disrupt or gain unauthorised access to the Service, or probe its security;
  • reverse engineer, resell, or misuse the Service beyond what these Terms permit;
  • infringe intellectual property or privacy rights, or post false or misleading content.

8. Third-party services

The Service integrates with third parties (for example Stripe for payments, and optional connections to Meta, Google, and Square). Your use of those services is governed by their own terms, and we are not responsible for them. Details of the providers we use are in our Privacy Policy.

9. Intellectual property

The Service, including its software, design, and branding, is owned by us or our licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. All rights not expressly granted are reserved.

10. Availability

We work to keep the Service available and reliable but do not guarantee it will be uninterrupted or error-free. We may suspend the Service for maintenance, updates, or reasons outside our control. The Service is provided "as is" and "as available" to the extent permitted by law.

11. Limitation of liability

Nothing in these Terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, or for fraud). Subject to that, we are not liable for indirect or consequential loss, loss of profits, revenue, or data, and our total liability arising from the Service in any 12-month period is limited to the fees you paid us for the Service during that period.

12. Indemnity

You agree to indemnify us against claims, losses, and costs arising from your breach of these Terms, your content, or the orders and goods you sell through the Service.

13. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends; sections intended to survive (such as payment obligations, intellectual property, and liability) continue to apply.

14. Changes to these terms

We may update these Terms from time to time. The "Last updated" date above reflects the latest revision, and continued use of the Service after a change constitutes acceptance of the updated Terms.

15. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except where mandatory local law provides otherwise.
